Legal agreement for using BrazyMed pharmacy management system.

Important: By using BrazyMed, you agree to these terms. Please read carefully before signing up.

1. Acceptance of Terms

By accessing or using BrazyMed ("the Software", "the Platform", "we", "us", "our"), you ("you", "your", "the Pharmacy", "the User") agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

These terms apply to all users including pharmacy owners, administrators, pharmacists, cashiers, and interns.

2. Description of Service

BrazyMed is a web-based pharmacy management system that provides:

  • Inventory management (drugs, categories, expiry tracking)
  • Point of Sale (POS) with receipt printing
  • Prescription processing and management
  • Patient records and medical history
  • Staff management with role-based access
  • Supplier and purchase order management
  • Expense tracking and financial reports
  • Email receipts and automated backups

3. Account Registration

3.1 Eligibility

You must be a licensed pharmacy, chemist, or healthcare provider in Kenya to register. By registering, you confirm you have the legal authority to bind your organization.

3.2 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorized access.
  • We are not liable for losses from compromised accounts.

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update it as needed.

4. Pricing & Payments

4.1 Subscription Plans

  • Free Trial: KSh 10 for 7 days (full access, no feature restrictions)
  • Monthly Plan: KSh 1,000 per month
  • Yearly Plan: KSh 9,000 per year (saves 25%)

4.2 Payment Terms

  • Payments are due at the start of each billing cycle.
  • We accept M-Pesa for automated payments and activation.
  • All fees are in Kenyan Shillings (KES).
  • No refunds for partial months or unused time.

4.3 Price Changes

We may change pricing with 30 days' notice. Your continued use after changes constitutes acceptance.

4.4 Late Payments

If payment is not received by the due date, access may be suspended until payment is made.

5. Data Ownership & Privacy

5.1 Your Data is Yours

All business, staff, and patient data entered into BrazyMed belongs to you. We do not claim ownership of your data.

5.2 Data Export

You can export your data anytime as CSV files. No vendor lock-in.

5.3 Data Deletion

Upon account closure, you may request data deletion. We will retain data for 30 days before permanent deletion unless legal obligations require longer retention.

5.4 Privacy Policy

Our Privacy Policy explains how we collect, use, and protect your information.

6. Acceptable Use Policy

You agree NOT to:

  • Use BrazyMed for any illegal activities or to violate Kenyan pharmacy regulations.
  • Attempt to access, modify, or damage the system, servers, or other users' data.
  • Use the platform to dispense medication without proper qualifications.
  • Enter false or misleading information.
  • Resell or redistribute access to BrazyMed without permission.
  • Use automated scripts or bots to interact with the platform.

7. Prohibited Activities

  • Medical Malpractice: BrazyMed is a management tool, not a clinical decision system. You remain fully responsible for all prescriptions and medical advice.
  • Data Mining: Scraping or extracting data for commercial purposes is prohibited.
  • Reverse Engineering: Attempting to decompile or reverse engineer the software is prohibited.
  • Harmful Code: Uploading viruses, malware, or harmful code is strictly prohibited.

8. Account Suspension & Termination

8.1 By You

You may cancel your subscription at any time. No refunds for prepaid periods.

8.2 By Us

We may suspend or terminate your account for:

  • Violation of these terms
  • Non-payment of fees
  • Illegal or harmful activity
  • Extended period of inactivity (12+ months)

8.3 Effect of Termination

Upon termination, you will lose access to the platform. You may request data export within 30 days.

9. Backup & Data Retention

  • We perform automated weekly backups and send them to your configured backup email.
  • You are responsible for storing these backups securely.
  • We are not liable for data loss if you fail to maintain backups.
  • We recommend keeping local copies of important data.

10. Disclaimer of Warranties

BrazyMed is provided "as is" without any warranties.

  • We do not guarantee that the platform will be uninterrupted, error-free, or secure.
  • We are not responsible for any medical decisions made using the platform.
  • You are solely responsible for complying with pharmacy regulations.
  • We do not warrant that the platform will meet your specific business needs.

11. Limitation of Liability

To the maximum extent permitted by Kenyan law:

  • We are not liable for any indirect, incidental, or consequential damages.
  • Our total liability is limited to the fees you paid in the 3 months preceding the claim.
  • We are not liable for data loss, lost profits, or business interruption.
  • We are not liable for any medical errors or prescription mistakes made using the platform.

12. Medical & Professional Responsibility

Critical: BrazyMed is a management software, NOT a medical device. The pharmacy owner and staff are fully responsible for:
  • All prescriptions dispensed
  • All medication advice given
  • Compliance with pharmacy board regulations
  • Proper patient record keeping
  • Accuracy of drug information

BrazyMed provides tools, but clinical decisions remain with licensed professionals.

13. Modifications to Service

We reserve the right to:

  • Update, modify, or discontinue features at any time
  • Perform maintenance with or without notice
  • Change pricing with 30 days' notice
  • Update these terms (continued use constitutes acceptance)

14. Third-Party Services

BrazyMed may integrate with:

  • Email services (for receipts and backups)
  • Payment processors (M-Pesa, etc.)
  • Hosting providers

We are not responsible for the practices of third-party services.

15. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Kisumu, Kenya.

16. Support & Service Level

  • Support Hours: 24/7 via email and WhatsApp
  • Response Time: Within 24 hours for non-urgent issues
  • Emergency Support: Critical issues prioritized
  • Uptime: We strive for 99.9% uptime but do not guarantee

18. Entire Agreement

These terms constitute the entire agreement between you and BrazyMed regarding the use of the platform. They supersede any prior agreements.

By using BrazyMed, you acknowledge that you have read, understood, and agree to these terms.
